Um, that's not a valid reason.

The only thing I can think of is since this is still an active case in the sense that it has not been adjudicated yet that the prosecuting agency (Moo U PD) has the ability to deny the release of any evidence to media outlets. Now, once this case is completed there is no legal way they can withhold that video with a FOI request. If Sammy has an Attorney and he or she submits a Rule 5 request (disclosure of all evidence the prosecution has) they can release that video...OF course we all know that will NEVER happen because he is going to get some type of pre-trial intervention and they obviously don't want this thing out there either. I'd be surprised if Sammy ever gets his own attorney though...I'm sure he is getting plenty of legal assistance from the University.

If I had to guess I would say they might argue something out of the first part of exemption 7. Not that I would agree but then again I'm not looking for a reason not to disclose. They obviously are.

Exemption Seven: Records compiled for law enforcement purposes, but only to the extent that the production of such law enforcement records:
Could reasonably be expected to interfere with enforcement proceedings;
Would deprive a person of a right to a fair trial or an impartial adjudication;
Could reasonably be expected to constitute an unwarranted invasion of personal privacy;
Could reasonably be expected to disclose the identity of a confidential source, including a state, local, or foreign agency or authority or any private institution which furnished records on a confidential basis;
Would disclose techniques and procedures for law enforcement investigations or prosecutions, or would disclose guidelines for law enforcement investigations or prosecutions if such disclosure could reasonably be expected to risk circumvention of the law; or
Could reasonably be expected to endanger the life or physical safety of any individual.

OK, I'll do it. It's way past time that something is done about those cheating bastards. It may be a good idea if several of us sent in E-Mails though instead of just one of us. Here's hoping that these E-Mails will be what it takes to force the NCAA into conducting a long over due investigation into that sewage pit.
