Former So Cal commit wrongly convicted, freed from prison

  • Read this. Probably happens more than you'd believe. A tragedy on many levels and one indictment of what is wrong with the American judicial system. I remember reading about him on Rivals when he was being recruited.

    Then he should have plead not guilty, and he should be pursuing charges against her. The person at fault is the girl, and apparently her mother. Bad legal advice by his attorney shouldn't be the states problem. No doubt a terrible deal for him, but the first person he should be suing is the "victim".

    Did the judicial system make her lie and get 1.5 millions for lying? The problem isn't the judicial system its the POS woman in the story. Even worse the greedy lady told him, I'll help you clear your name but don't want to give the money back. School districts have ZERO money now and our taxes pay for them. The school district should sue her tomorrow for 1.5 million plus interest. She is a POS.

    Of course Doc. Point is the judicial system still failed him. Woman's lies accompanied by an attorney "just doing his/her job" gets the dude railroaded. But where was the evidence? Nice system.

  • A 15 year old that said she was raped. Human emotion. People will believe a 15 year old girl who cries and says whe was raped. If it was my daughter, I might have tried to kill the guy myself. IF she was lying then she is the issue. Guys don't get the benefit of the doubt, girls always do. 99% of the time the 15 year old is not going to lie. The odds are a million times more that she doesn't tell anyone than she lies about it for a false conviction. Does it suck for him--100% yes. You will never get a perfect answer everytime in anything in life. The question is why will he not sue her but wants to sue the state for $100 a day. Something fishy about that. The state didn't fail him a POS did.

    I agree our system has terrible flaws in it. Just like anything controlled by people because of greed, politics, and doing your so called job going through the motions people are wrongfully accused daily.

    This story happens all the time maybe in this case there is something fishy but the judicial system has flaws people are wrongfully accused and put in jail all the time for many different reason. Public pressure, greed, attorneys taking the easy road and many other reason. Not all attorneys do this and not all people that are accused get screwed but it happens to much and it is definitely a problem.

That's about a 99.99% success ratio.Furthermore, many more times that many people have been wrongfully found not guilty, then gone out and committed another crime. If anything, our system is broken in the opposite direction of what you believe. I would much rather have 15 guys sitting in jail with wrongful convictions (yes, even if it was me) than to let one murderer or rapist off the hook.

    What system would you suggest, that could produce perfect results?

    I hate it for him. I hope I'm never in his shoes. But to say he's going after the state, but not the girl is asinine. I agree with what was said above... he should have pled not guilty.

    It appears that way to me, too.

    Another factor is that Banks pleaded no contest, rather than fight the charges. Of course, it's possible that, being a scared teenager, he took a plea deal rather than face the possibility of a conviction at trial and a longer sentence.

    I don't believe you when you say this, but if you truly feel this way, you are a danger to our society in a very different sense. One of the most appalling things I've ever read. Yeah, just let 15 innocent black kids have their livelihood taken away, because there are plenty of other people accused who did indeed commit the crime.

    You seem terribly uneducated, so I'll go ahead and enlighten you here. The legal standard is proof beyond a reasonable doubt -- NOT, I think he might've done it, so lock him up because we can't take any chances. Absolutely unbelievable post on your part. I hope to hell you have this happen to you after making such an irresponsible statement.
