If this is true send him packing but before we throw him under the bus lets here the whole story. This could be a lie the girl is trying to cause trouble like in the Duke Lacrosse case and many other cases. If he did do these things he's accused of he needs to go a go quickly.

She obviously got drunk and did something she regretted. That's her own damn fault.

it is sad that if a female is drunk and has sex with a man but then later decides i wish i hadnt done that she can claim rape....how come the man cant say i was drunk and i woke up with the skeet scat scallywag here and she probably took advantage of my drunken state...she should be arrested

It's called an investigation. Would you want someone to report that you had raped them and 20 minutes later threw you in jail facing rape charges? She reported it, the police did their investigation, and they signed warrants. It's called police work.

Well, for one, he was not accused of rape, he was charged with "Third Degree Sexual Misconduct" which is an entirely different animal altogether. Obviously, I don;t know the circumstances of the situation but it VERY EASILY could be a case of a scorned woman. According to the story, they were dating and she came to his apartment at 11 p.m. after a night of partying in Five Points. This could mean that she passed out and he got some anyway,

SECTION 16-3-654. Criminal sexual conduct in the third degree.
(1) A person is guilty of criminal sexual conduct in the third degree if the actor engages in sexual battery with the victim and if any one or more of the following circumstances are proven:
(a) The actor uses force or coercion to accomplish the sexual battery in the absence of aggravating circumstances.
(b) The actor knows or has reason to know that the victim is mentally defective, mentally incapacitated, or physically helpless and aggravated force or aggravated coercion was not used to accomplish sexual battery.
(2) Criminal sexual conduct in the third degree is a felony punishable by imprisonment for not more than ten years, according to the discretion of the court.
